Below is a message from Judge Jones regarding the Attorney ad Litem lists for Bell County.

On July 1, 2022 the Bell County District Courts will begin to utilize new lists of ad litem appointments for the following categories:

Civil cases
Family law cases
Real estate cases
Friendly suit guardian ad litems
Family law guardian ad litems

The requirements for those positions and applications to be on the lists can be found on the Bell County website under the heading “District Courts”.

If you are already on a list and wish to continue, it will be necessary to submit a new application to verify your qualifications.

• Agreed announcements can still be sent by e-mail. The AGREED announcement deadline is NOON the business day before the hearing. If announcements are not submitted by deadline the attorney and defendant are required to appear for docket call.

Remote Hearing Policy / Bell County Dist Court

Effective August 1^st all trials, hearings and other proceedings in Bell County District Court shall be conducted in person. See attached policy.

Consent for a hearing to be conducted remotely (or a party to appear remotely) will only be permitted by written order for good cause and not for the convenience of the parties and/or the attorneys. This consent MUST be granted by the Court prior to hearing date. Any permitted remote proceeding shall be subject to the Bell County District Court Local Rules, including rules regarding attire and conduct in the court room.

All felony announcement and pretrial dockets (this DOES NOT include jury trial docket calls) will still be done by e-mail to the Court with the agreed announcement prior to the court date.

Because of water and sewer issues, the Bell County Justice Complex will be closed tomorrow - Monday (2/22).

Family / Civil dockets for the 146th and 169th District Court will proceed as scheduled with remote hearings.

The Criminal dockets for the 264th and 426th District Court will be cancelled and reset for another day.

If you are scheduled for a family law hearing tomorrow in the 264th or 426th please contact the court coordinator to find out if the hearing can be heard.

The 27th District Court is scheduled to be in Lampasas tomorrow and there will be no hearings in Bell County.

Please submit your comments, if any, to me as Local Administrative Judge on or before Friday, August 21, 2020. The Revised BCSO updates various provisions and adds language concerning electronic data as per the Texas Family Code. The primary change to the Revised BCSO is that it mandates Alternative Dispute Resolution, unless waived by the Court, for all cases filed on or after September 1, 2020.

COVID 19 OPERATING PLAN FOR BELL COUNTY JUDICIARY

Attached is the COVID-19 Operating Plan for the Bell County Judiciary which was approved by the Presiding Judge of the Third Administrative Judicial Region on May 27, 2020. A copy of the email from Judge Stubblefield approving the Plan is also attached. The approval of this Plan will allow courts in Bell County to proceed with non-essential, in person hearings beginning June 1, 2020. These hearings will have to comply with this Plan, the prior orders of the Texas Supreme Court, and the guidelines of the OCA. The District Courts have elected to primarily continue with video-conference hearings via Lifesize through the month of June. We plan to start transitioning to a combination of Lifesize hearings and in person hearings in the month of July. All of this could change, of course, if the Texas Supreme Court and OCA place further restrictions on the courts. For information about procedures for specific courts, please contact the court coordinator for each court by e-mail or as requested by that particular court. In addition, please note that Emergency Order #17 of the Texas Supreme Court, dated May 26, 2020, has extended the suspension of jury trials until at least August 1, 2020.

When a case is ready to plea, our office will be sending you a link to the SignNow application for the signing of plea papers. After a defendant has agreed to enter a plea of guilty, either to our offer or open, please contact the prosecutor by e-mail. The link to plea documents will then be sent to you and a link will also be sent to the jail so that your client will be able to sign the plea paperwork electronically. You will then have the opportunity to go over the paperwork with your client, using the Securus video call system. E-mail the following address to set up an appointment between 8 am and 4 pm to obtain the defendant’s electronic signature:

Please state in your e-mail: defendant’s name, cause number for each case you are requesting a signature, and that you are ready for your client’s signature.

You will have to set up an appointment on Securus to correspond with the time provided by the jail. An assigned deputy will then make contact with the defendant in the jail and use the available link for the defendant to electronically sign the necessary paperwork. You can communicate with your client through Securus while the defendant has the electronic documents in front of him and obtain his signature. Once you and your client have signed the plea papers, they will then be e-filed by our office with the District Clerk and will be ready for your plea setting.

We have added a waiver for the defendant to appear by teleconference that will be included in the plea paperwork.

Here are the Steps:

Contact our office by e-mail to let us know your client is ready to enter a plea.
Wait for link from SignNow containing the plea paperwork.
Set a Securus appointment for a time between 8 am and 4 pm to communicate with your client.
Contact the jail at bcjail.signnow@bellcounty.texas.gov to inform them of your Securus appointment time to sign the paperwork.
Contact your client at the appointed time and a jailer will provide a tablet to the inmate to obtain his/her signature.

Use the provided link from SignNow for you to electronically sign the paperwork.

The Securus coupon codes are good for one time use, a code can be used to discuss the plea and plea paperwork in advance, if necessary; and a second code can be used during the appointment to obtain the electronic signature. Our office will send you a batch of codes to use for this purpose and additional codes can be requested by contacting Stacy McClinton at Stacey.McClinton@bellcounty.texas.gov .

Securus video calls

Our office has been successful in working an agreement with Securus which will allow a free visit with your client using the Securus video call system. To be able to access the Securus program you will need to register before you can use it. Securus has agreed to provide this free of charge service by providing promotion codes (coupons) that you will use to enter the Securus system. In reaching an agreement with Securus we agreed that these coupons should only be used for the purpose of contacting your client for finalizing the necessary plea papers for a plea of guilty that is set on the docket. I mention this so that to the degree possible please use your discretion to stay within the spirit of this agreement. At any time Securus could revoke this privilege or revoke them for an individual attorney that may be misusing the coupons. Secondly, my office will keep and administer the coupons to individual attorneys as the need arises. We have been supplied with the coupons, to obtain them you will need to email Stacy McClinton at Stacey.McClinton@bellcounty.texas.gov and make the request. Should you need any technical assistance please feel free to contact Stacey McClinton for any help concerning Securus, please use her email address and provide a contact number so that she can call if needed.

The District Judges hearing cases are passing cases set for hearing during the week of March 30. This applies to all cases which require a physical presence and hearing. The pretrial announcements, revocation announcements, etc. will continue to be done by email to the Court Coordinators with a copy to the State’s attorney. Hearings requiring a physical presence that are presently set the week of March 30 are passed UNLESS attorneys requesting to retain their setting contact the appropriate Court Coordinator by email by noon on Thursday, March 26, with an agreed time for a phone conference with the Court. It will be the responsibility of the attorneys to coordinate a time for the phone contact with the office of their opposing counsel.

What this means is that criminal cases set for appearances next week (including pleas, sentencings, etc.) are reset UNLESS you and opposing counsel have a conversation with the Court and show a good reason why your case is essential and should remain on the docket. That conversation will need to take place before the close of business on Thursday, March 26.

Please review your dockets promptly!

We are instituting the following interim procedures immediately:
1.    Please instruct your client, witnesses, etc to remain in the hallways until their case is heard. We are under directives to maintain social distancing. You should maintain a minimum distance of 3’ to 6’ between yourself and all other persons.

2.    Cases (pleas and uncontested sentencings) will be scheduled at 15-minute intervals. We will try to accommodate your schedules as much as possible. If you will contact the court coordinator no later than noon on the day before the setting, the coordinator can set your cases for specific
times during that day. It is absolutely essential that you appear at the time of your specific setting. The number of inmates in holding tanks is further limited by new requirements and your inmate will not be available for long period of time. If your client is on bond, it will be your responsibility to notify them of the specific time of their setting.

3.    Non-jury trials, contested sentencing hearing, and contested revocation hearing, pre-trial motions, etc. will be specially set as time permits. Please advise the court or the coordinator of the estimated length of the hearing at the time the case is set. If witnesses and spectators at a hearing exceed 12 people, please talk with the court regarding scheduling. You can expect a delay in hearings where 12 or more people are expected to appear.

4.    Do not appear at Thursday or Friday docket calls (pre-trial, revocation announcements, arraignment, jury docket calls). Advise your client not to appear for routine Thursday or Friday docket calls. You should send an email to the coordinator with a copy to the State’s attorney, by
noon on the day before docket call. In that email you should make your announcement to the court and advise a proposed date for the next setting. Also, if you are setting a plea or uncontested sentencing, please suggest a proposed time for the setting. If an email is submitted to a
coordinator that does not include notice to the State’s attorney, that email will be returned to you without action. Cases requiring a record will still require the presence of you and your client.

5.    So long as no jury panels are available, all jury trials will be reset 90 days. If the new date is not convenient for you or the State, please contact the coordinator or court for an agreed reset date.

We are hopeful that these new procedures will reduce the number of persons in the courthouse and in our courtrooms at any particular time. We want to continue to hear criminal matters without creating unnecessary backlogs. However, if you or your client are ill or not feeling well, please
advise the court prior to your setting. We do not want to risk anyone’s health. Cases can be reset.

The Supreme Court and Court of Criminal Appeals here ordered all courts in Texas to take action to avoid exposing court proceedings to the threat of COVID-19. To accommodate this directive until further notice, all proceedings in the 146^th District Court will be subject to the following:

1. “Essential hearings” that will be conducted as usual are only for family violence protective orders, temporary restraining orders and other matters approved by the Court.
2. Any other hearing will be conducted by telephone only, provided that all parties agree to a telephone hearing. In such instances, the attorneys/self-represented litigants must make arrangements at least one day in advance through the court coordinator, who will provide further instructions.
3. If you have a hearing already scheduled, contact the Court Coordinator (by telephone or email) and advise her of your plans. If we do not hear from you your hearing will be removed from the docket.
4. All statutory and court imposed deadlines are suspended until further notice.
5. Please be patient. We do not like this any more than you. We will attempt to accommodate you as much as we reasonably can.

Due to various government ordered shutdowns and closures, today I issued orders for the Rosebud, Lott and Mount Calm courts to allow defendants to request a COVID-19 Variance on all mail, fax, window, online, and in-person no-contest and guilty pleas.

The order ensures penalties for criminal acts but ensures that necessary financial resources are maintained by citizens so they can effectively respond to the crisis.

Requests for deferred adjudications and Driver Safety Program are eligible for the variance. The COVID-19 Variance will reduce the fine or special expense fee amount by 50%. Court costs are not eligible for the variance. Defendants, as always, may continue to exercise their rights and request indigency status, alternatives to payments, and payment plans. This variance in no way limits a defendant's right to request a trial by judge or jury nor any other right provided by the US and Texas Constitutions.

TEMPORARY CHANGES REGARDING THE PRETRIAL DOCKET IN CCL#2

Beginning March 16, 2020 and continuing until April 10, 2020 the following changes will be implemented regarding the Wednesday afternoon docket in the CCL#2..

These changes are intended to reduce the number of people at Court proceedings

Attorneys are encouraged to use alternate means already in place, such as Case Setting Forms and Agreed Motions for Continuance, to make pretrial and revocation announcements.

The defendant’s appearance at the Wednesday 1:15 p.m. docket is waived for pretrial and revocation announcements until after April 10, 2020.

Save the date!

The Bell County Bar Association's Veteran's Clinic will be on November 8, 2019 at the Temple VA Hospital from 1:00 p.m. to 5:00 p.m.

As always with the fall clinic, we expect a big turnout and need your assistance in helping our Veterans.

You can volunteer for an hour, two hours, or all four hours. We can use your help! By volunteering, you are not taking on any obligation to represent a Veteran, although you may do so if you wish. We need our attorney volunteers to screen cases and discuss the case with the Veteran, if you are able. For those Veterans who present issues that need additional time and/or work, we have a network of attorneys to whom we can refer cases.

Most of the issues presented are basic questions about family law, consumer law, landlord-tenant law, and Veteran's law. We also provide each attorney with a handy guide that answers many of the Veteran's questions.

I am reaching out to you on behalf of Baylor Undergraduate Mock Trial. We are hosting a tournament this weekend at Baylor Law School and are short on judges. I know there are many Baylor Lawyers and fellow trial advocates in the area, and if possible, I would appreciate it greatly if the following message could be sent out to the members of the Bar Association to help us out!

Greetings,

My name is Brandon Cooper, and I am the treasurer of Baylor Undergraduate Mock Trial. Each year, we host a tournament where many universities across the United States come together to compete at Baylor Law School. We have hosted this tournament for 15 years now, and are looking to host another great tournament again this year. A big part of preparing for the tournament is getting qualified individuals to help out and volunteer as judges, and that is where you come in!

Our tournament will be held this weekend, Friday, November 30 through Sunday, December 2. There are four rounds of competition, which are to take place at the following times:

Round 1 (Friday)- 6:30-9:30
Round 2 (Sat) - 9:00-12:00
Round 3 (Sat) - 2:30–5:30
Round 4 (Sun) - 9:30-12:30

We are still short on judges, and would appreciate all the help we could get! Judges can sign up to participate in any single one of the rounds. Refreshments will be provided to judges helping with any round. Attached is a link where anyone interested may sign up to judge.

Volunteer Attorneys Needed for Spring Veterans Clinic

The Bell County Bar Association will be sponsoring a legal clinic for veterans on Friday, April 27, 2018, at the Texas Workforce Commission located at 300 Cheyenne Drive, Killeen, Texas 76542.

We still need attorney and paralegal volunteers to help staff the clinic, and attorneys who are willing to take one or more cases/referrals from the clinic. No document prep is done on site. Some veterans have cases which can be resolved with just a short consultation. Some veterans have cases that require representation. Volunteer attorneys do not have to represent those veterans, as they will be referred to another attorney in that situation.

AGAIN, PLEASE UNDERSTAND THAT YOU ARE NOT OBLIGATED TO ACCEPT A REFERRAL. You will be merely be interviewing veterans to determine if they need an attorneys assistance and then determine what kind of an attorney the clinic should connect the veteran with.

Obviously, the more volunteers there are, the better the chance that every veteran is provided the legal assistance that they need.

None of us can do everything, but all of us can do something.

We must submit our first-place local winners from each category to the State Bar for the statewide contest by Wednesday, March 30, 2016. The top three winners in each statewide category will be invited to the State Bar of Texas Law Day celebration, which will be held Monday, May 2, 2016 in Austin.

The information you will need are: 1) Memorandum, and-- either 2) Renewal Application, or 3) Original Application.

PLEASE DO NOT RETURN THIS PAPERWORK TO THE BAR, you must complete and present it to Bell County Human Resources Department when you go to have your badge issued / renewed.

To have your badge issued / renewed, please go to the 3rd floor of the historical courthouse in downtown Belton. Present your paperwork to HR between 8:30 a.m. and 4:00 p.m. YOU MUST BE CURRENT ON YOUR DUES TO HAVE A BADGE ISSUED / RENEWED. BADGES WILL NOT BE ISSUED IF DUES ARE NOT CURRENT, NO EXCEPTIONS!!!

Bell County will be hosting its SIXTH Adoption Day Event on Friday, November 14th. So far there are twelve families participating, adopting approximately twenty kids (though those numbers may change before the event!). It is anticipated that opening remarks will be made at 9:30 a.m., with the first cases being called at 9:45 a.m.

If you or your firm are interested in making a donation to help offset the costs, please mail your check, payable to BCBA, to PO Box 282, Belton, TX 76513. Please note "Adoption Day" in the check memo so that your donation is applied correctly.

For those who are new to the Bar, the Adoption Day event is to help finalize and create "Forever Families" for children who have been living in foster car, and who are being legally adopted by these families. The Bar provides each family with a gift bag that includes age appropriate toys for the children, as well as gifts for the parents, a disposable camera for the kids to use, and other goodies! The Bar also purchases pop up Wizard of Oz books for each family, and decorates the courtrooms with a Wizard of Oz theme to make this day exceptionally special for these special families and children!!

If you are at the Courthouse on November 14, even if you're not involved in a case, please stop by the 169th or 264th Courtroom and watch as these families become 'forever' on this memorable day!!!

The Bell County Bar Association is pleased to announce the agenda for the 2014 Fall Bench Bar Conference which will be held in the 146th Judicial District Courtroom, Bell County Judicial Complex, on September 25, 2014.

Check-in will begin at 8:15 a.m. The event is FREE to paid members of the BCBA and the BCBAP; while the non-member attorney cost is $50 at the time of registration, and the non-member paralegals cost is $30 at the time of registration. Note: If you have staff who are NOT members of the Paralegal group, they can attend the entire CLE for $25 OR just the e-filing portion for $10. Lunch and an afternoon snack are included!

Early registration ends on September 23rd. WALK-INS WILL BE ACCEPTED, BUT ARE NOT GUARANTEED MATERIALS OR LUNCH. Please email bell_co_bar@yahoo.com if you plan to attend so we can get you registered as soon as possible!!

The program has been approved for 5.75 hours participatory and one hour of ethics CLE credit.
